Terms of Use
These terms govern the use of the OnAim app (iOS and Android) and the website onaim.app. Please read them carefully before using the service. The German version is legally binding; this is a courtesy translation.
1. Scope and provider
The provider and your contracting party for the use of the app is:
MAK C.E.T GmbH
Heidenfelder Str. 1
97525 Schwebheim
Germany
Represented by: Mr Michael Ali Kilic
E-mail: [email protected]
Registry: Amtsgericht Schweinfurt, HRB 6561
These terms apply to all users. Deviating terms of the user do not become part of the contract unless we expressly agree to them in text form. Purchasing a subscription is additionally governed by the terms of the respective app store (section 6).
2. What OnAim is — and what it is not
OnAim is a companion app for sport shooting (IPSC and BDS). It provides in particular a personal shooting log, a match calendar, training analysis and a private equipment overview.
For the avoidance of doubt, OnAim is expressly not:
- an interface to the National Firearms Register (NWR) or to any public authority. No data is transmitted to authorities.
- a marketplace or trading platform. Firearms, ammunition and accessories can neither be bought, sold, brokered nor advertised through OnAim.
- a substitute for records, proofs or notifications required by law. Compliance with firearms law (in particular the German WaffG) is your responsibility alone. The entries kept in the shooting log are a private record for your own use.
- advice on legal, medical or safety matters.
Your equipment entries form a private record: they are visible only to you and are never displayed publicly. For details on data processing see the privacy policy.
3. Account, age limit and credentials
Use requires an account. Sign-in is passwordless via e-mail (one-time code or magic link). Registration concludes a free of charge usage contract between you and us.
- OnAim is intended exclusively for adult sport shooters (aged 18 and over).
- Your details must be accurate; please keep changes up to date.
- Sign-in codes and magic links are personal. Do not pass them on, and protect access to your e-mail inbox.
- You may terminate the free usage contract at any time and without notice by deleting your account (Settings → Delete account; see onaim.app/en/delete-account).
4. Your content and obligations
The content you record (entries, notes, photos) remains yours. You grant us only the simple right to store and process it for the purpose of providing the features. Publication takes place only where you expressly allow it.
In particular, you undertake:
- not to submit unlawful, infringing or abusive content;
- to record personal data of third parties (e.g. the name and licence number of a range officer) only where you are entitled to do so;
- when photographing targets, to ensure that no people and no third-party objects are captured;
- not to query the app in an automated or bulk manner, not to decompile it and not to circumvent security measures;
- not to introduce malware and not to disrupt operations.
In the event of serious or repeated breaches we may block access after prior notice; in the event of severe breaches also without notice. Your right to export your data or delete your account remains unaffected.
5. OnAim Pro — scope and prices
The core features of OnAim are free to use, subject to volume limits (currently one firearm and 50 shooting-log entries). An OnAim Pro subscription removes these limits and unlocks the Pro features. The current scope of features is shown to you on the subscription screen in the app.
- OnAim Pro — annual: €29.99 per year
- OnAim Pro — monthly: €3.99 per month
All prices are final prices including any applicable VAT. The price shown to you in the App Store or on Google Play immediately before purchase always prevails; it may differ depending on country and currency.
We offer a 7-day free trial on the annual subscription. It applies to the annual plan only, not to the monthly plan, and only if you are eligible under the rules of the relevant store — as a rule, only when you take out an OnAim Pro subscription for the first time. Whether a trial is available to you, and for how long, is shown to you in the App Store or on Google Play immediately before purchase; that display prevails.
No charge is made during the trial. Unless you cancel at least 24 hours before the trial ends, the subscription automatically converts to a paid annual subscription and your store account is charged the annual price stated above. Cancelling during the trial follows the same route as any other cancellation (see section 7) and is free of charge until the trial ends.
The subscription renews automatically for the selected term (one year or one month) at the price then applicable, unless it is cancelled at least 24 hours before the end of the current period. Your store account is charged for the following period within the last 24 hours of the current period.
6. Contract conclusion via App Store and Google Play
Important: you do not purchase the subscription from us. The purchase contract for the subscription is concluded exclusively between you and the operator of the respective app store — Apple on iOS and Google on Android. They are the seller and your contracting party for the payment.
- Payment processing, invoicing and payment methods lie exclusively with the store operator. We receive no payment data (e.g. card or bank details).
- The purchase is therefore additionally governed by the terms of use and sales terms of the respective store as amended from time to time.
- Our role is to provide the unlocked features. To map your subscription to your account we use a processor; for details see section 11a of the privacy policy.
7. Cancelling the subscription
You can cancel the subscription at any time — cancellation happens in the settings of your store account, not with us:
- iOS: Settings → [your name] → Subscriptions — or apps.apple.com/account/subscriptions
- Android: Google Play → profile → Payments and subscriptions → Subscriptions — or play.google.com/store/account/subscriptions
In the app, "Manage subscription" takes you directly to the right place. Cancellation takes effect at the end of the period already paid for; until then the Pro features remain available. After that, OnAim remains available to you in the free version — your data is retained, only the volume limits apply again.
Cancelling during the free trial: the route is the same. If you cancel at least 24 hours before the trial ends, nothing is charged; the Pro features remain available until the trial ends.
8. Withdrawal and refunds
Because the subscription contract is concluded with the store operator (section 6), any right of withdrawal and any refunds are governed exclusively by statutory provisions and by the terms of the respective store. Your statutory consumer rights vis-à-vis the store operator remain unaffected; these terms neither limit nor shape them.
We can neither collect nor refund payments. Please direct refund requests to Apple or Google. We are of course happy to help with technical questions — [email protected].
9. Availability and changes to the app
We aim for high availability but do not owe uninterrupted accessibility. Maintenance, service-provider incidents and circumstances beyond our control may lead to temporary restrictions. Many features also work offline, as data is additionally stored locally on your device.
We may continue to develop the scope of features. If paid features are materially and not merely insignificantly changed or discontinued to your disadvantage, we will inform you in good time; in that case you may cancel the subscription with effect from when the change takes effect.
10. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, where a guarantee has been assumed, and under the German Product Liability Act.
In cases of slight negligence we are liable only for the breach of material contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely), limited to the foreseeable damage typical for this type of contract at the time the contract was concluded. Any further liability is excluded.
Your own responsibility: you alone are responsible for the accuracy of your entries and for compliance with firearms, safety and range regulations. Results of the automatic hit detection are suggestions which you can review and correct.
Backups: we protect our systems with industry-standard care. Nevertheless, you should additionally back up records that are indispensable to you outside the app.
11. Changes to these terms
We may amend these terms where this is necessary due to a change in the law, case law, technical conditions or the scope of features. We will notify you of any amendment at least 30 days before it takes effect, in text form or in the app. If you do not object before it takes effect, the amendment is deemed accepted; we will point this out separately in the notice. If you object, you may terminate the contract with effect from when the amendment takes effect.
12. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If, as a consumer, you are habitually resident in another state, the mandatory consumer protection provisions of that state remain unaffected.
EU Commission platform for online dispute resolution: https://ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
Should any provision of these terms be invalid, the validity of the remaining provisions remains unaffected.
